Federal Judge Pauses Order Disqualifying US Attorney for Nevada
A federal judge has paused his order disqualifying the acting U.S. attorney for Nevada from overseeing several criminal cases.
U.S. District Judge Campbell granted the government's motion to stay his ruling against Sigal Chattah's appointment pending an appeal to the Ninth Circuit.
Chattah was initially appointed by President Donald Trump as Nevada's interim U.S. attorney and was later reclassified as the "acting" U.S. attorney, bypassing the Senate confirmation process.
Federal public defenders in four criminal cases filed motions arguing that this workaround violates the Federal Vacancies Reform Act.
Campbell, a senior judge for the district of Arizona, initially sided with them in an order issued last month.
The order has been paused pending an appeal to the Ninth Circuit.
